UK’s deportation plan for Rwandan asylum seekers legal, court rules

A government victory will not mean flights can take off straight away as there could be further appeals in British courts and an ECHR injunction imposed during the summer prevents any immediate deportations until the conclusion of legal action in the United Kingdom.

In a partial victory for the claimants, the judges said that the UK Home Secretary, Suella Braverman, should have properly considered the circumstances of each claimant.

The judges said a further hearing would take place on January 16 to determine any application for permission to appeal against the court’s decision.

Taufik Hussain, a lawyer representing six of the eight asylum seekers, said: “We are considering the position regarding the policy being declared valid, but we welcome the decision regarding individual claimants.”

“The court has made it very clear that (the Home Secretary’s) approach to individual decisions has been illegal and needs to be reviewed.”
