Is it legal to handcuff an elderly person in Bangladesh?

Elaborating on the situation when a person can be handcuffed, Section 330 of the Bangladesh Police Rules states that it is not advisable to adopt more stringent methods than necessary to prevent a person from escaping. The use of handcuffs or ropes is unnecessary and undignified in most cases. A person detained in a bailable case cannot be handcuffed.

Bogura Sadar UNO Firoza Parveen said that Rezaul Karim and others obstructed government work. This charge was made under section 186 of Bangladesh CrPC. This means that a court order is required to arrest any person on this charge and the offense is bailable.

Speaking to Prothom Alo, Ain O Salish Center president and Supreme Court lawyer ZI Khan Panna said, “Legal procedures were not followed in handcuffing farmer Rezaul Karim and others for six hours before releasing them.”

“Is Razaul Karim a thief or a robber? Is there any record of his previous criminal activities? If there is no such record then why was he handcuffed and taken from one place to another for six hours?” He asked.

Zee Khan Panna further asked whether his honor was not hurt by this detention? Who will compensate them?

He said that the constitution of Bangladesh says that the people are the source of all power. Article 35(5) of the Constitution states that no person shall be subjected to pain and such punishment is cruel, inhuman and degrading.
