In January 2017, the state appealed against this decision of the High Court. On July 3 the same year, a seven-member full bench of the Appellate Division, headed by the then Chief Justice Surendra Kumar Sinha (SK Sinha), unanimously dismissed the appeal.

The full decision of the Appellate Division was published on August 1, 2017.

In his remarks, the then Chief Justice SK Sinha commented on various issues including democracy, politics, military rule, Election Commission, good governance, corruption and independence of the judiciary.
