President returns Bangladesh Labor (Amendment) Bill-2023 for reconsideration: Confusion over penalty clause

It said, “It is clear that Section 45 of this Bill may create confusion. Therefore, it is necessary to reconsider that section. “The bill was returned to Parliament for reconsideration in accordance with Article 80(3) of the Constitution of the People’s Republic of Bangladesh.”

Sources concerned said the provision that was advised to be reconsidered is about punishment for illegal strike or lockout, which is Section 294 of the main law. Sub-section 1 of this provision mentions the punishment of workers for illegal strike, and Sub-section 2 mentions the penalty of employers for illegal lockout. However, the penalty is the same for both the cases. But the amended bill increased the fine for workers from Tk 5,000 to Tk 20,000, while the fine for employers would remain unchanged as sub-section 2 was not amended. Furthermore, the amended Bill mentions provision number 291, which is actually 294, and this may lead to confusion. That is why this bill was returned for reconsideration.
